
Telecommunications Law
Kissinger & Fellman attorneys’ expertise in telecommunications
law includes an active practice on behalf of clients impacted by
the Telecommunications Act of 1996, the Cable Acts of 1984 and 1992,
and the regulatory proceedings before the Federal Communications
Commission with respect to the implementation of this legislation.
We have worked with local governments throughout the country on
matters relating to compliance with and interpretation of federal
and state communications laws. The Firm has assisted clients
in drafting comprehensive telecommunications policies, zoning ordinances
addressing towers and antennas, and right-of-way management ordinances,
conducting community needs assessments, negotiating cable franchise
agreements, and development and implementation of wireless broadband
networks. We have also represented clients in state and federal
court litigation relating to the 1996 Telecommunications Act, and
in FCC rulemaking proceedings. Ken Fellman regularly speaks on telecommunications
issues, and is widely published. He is a member of the Board of
the National Association of Telecommunications Officers and Advisors,
and previously served as President of its Colorado chapter. In February
1997, the Federal Communications Commission appointed Ken Fellman
as a member of its Local and State Government Advisory Committee,
where he served as Chair until the Committee was terminated in July
2003.
Kissinger & Fellman works with local governments in the negotiation
and drafting of new franchises, franchise renewals, and franchise
transfers for cable television, open video systems, and multi-channel
video programming distribution systems. The Firm has also been retained
to provide advice on, and prosecute cable television franchise violations.
These matters have ranged from relatively straightforward negotiations
lasting four to six months, to complex multi-year projects.
The Firm has also worked with local governments, Tribal governments
and private property owners in the negotiation of right of way agreements,
provision of telecommunications services, and zoning of telecommunications
facilities.
Our telecommunications clients range from very small towns to large
cities and counties, and are located throughout Colorado and across
